Welcome to The Creation Story website owned by Medicine lodge Confederacy (MLC). By using our site at thecreationstory.co (the “Site”) and the services we offer, including the opportunity to donate to the Medicine Lodge Confederacy, by way of streaming our film and/or buying merchandise (the “Services”), you agree to these Terms and Conditions (“Terms”). Please read them carefully, and feel free to contact us if you have any questions!

1. Intellectual Property

1.1 Our Content Is Ours
 All the cool stuff you see on our Site, including films, artwork, logos, and designs, are protected by copyright and other intellectual property laws. That means everything is owned by us or our partners, and we ask that you respect our hard work.

1.2 Films for Personal and Communal Use
When you buy a film from us, you're getting a license to access it and watch it whenever you like through your account on the Site. This is for personal and communal use only, so that both you, and your community can enjoy the film, but please don’t copy, or redistribute it without our permission. We appreciate your respect for our content and copyright.

1.3 Merchandise Designs
 The cool designs on our merchandise are also ours, and they’re not for commercial use unless we say otherwise. If you’re buying one of our shirts, mugs, or posters, it’s for your personal enjoyment, or that of the lucky person you are gifting it to, it is not to resell or redistribute.

2. Purchases and Refund Policy

2.1 How Orders Work
When you purchase a film or merchandise, you’re agreeing to pay for it. For films, you’ll create an account on the Site to access and view your purchase. For merchandise, we’ll process your order through third-party fulfillment platform, Printify and its production partners.

2.3 No Refunds on Film Sales
Since films are digital products that you can access through your account, all sales are final. We do not accept returns or offer refunds once a film has been purchased. If there’s an issue with your access to the film (like a broken link or trouble viewing), please reach out to us at creationstory@wearequiet.com and we’ll help resolve the issue.

2.4 No Refunds on Merchandise
Merchandise/ poster sales are final, as they are custom-produced and shipped directly by Printify and its production partners. If you receive a damaged or faulty item, please contact us at creationstory@wearequiet.com within 7 days of receiving it, and we will work with Printify to resolve the issue.

2.5 Shipping and Delivery
For merchandise, please note that all fulfillment is handled by Printify, a third-party service, and its production partners. Shipping times and costs are calculated at checkout. We’ll do our best to ensure everything arrives on time, but we can’t control production delays from Printify. For films, there’s no shipping—just access via your account.

2.6 International Shipping and Import Charges
If you purchase products from our website for delivery outside of the USA, please be aware that you may be subject to additional import taxes, customs duties, handling fees, and other charges and taxes that are levied once the shipment reaches your destination country. These charges are typically based on the item's value, the destination country’s tax regulations, and any relevant tariffs.
Please note that these additional charges are not included in the item price or shipping costs you pay at checkout. You are responsible for any such fees incurred upon receipt of your order. We recommend checking with your local customs office for information regarding applicable fees and regulations prior to placing your order.

3. GDPR Compliance and Your Privacy

3.1 How We Handle Your Data
We take your privacy seriously. By using our Site, you agree that we can collect and process your personal data, such as your name, email, shipping address, and payment details, to fulfill your orders and provide and improve our service.

3.2 Your Rights Under GDPR
If you’re based in the EU, you have rights under the GDPR, including:

  • The right to access and update your personal data.
  • The right to ask us to delete your data (with some exceptions).
  • The right to object to how we process your data.

4.1 Play Nice
We want everyone to have a good experience using our Site, so please don’t:

  • Do anything illegal or fraudulent.
  • Spread harmful content (like viruses or malware).
  • Violate any laws in your country.

4.2 Your Account
When you create an account to access films, you’re responsible for keeping your login details safe and for all activities that occur under your account. If you think someone has accessed your account without your permission, please let us know right away, and we’ll help you secure it.

5. Limitation of Liability

We’re committed to providing a great experience, but sometimes things go wrong. So, while we will always do our best, we can’t be held responsible for things like indirect or accidental damage that may occur from using our Site or Services, including lost data or profits, or other intangible losses.

We may update these Terms from time to time. If we make any important changes, we’ll let you know by updating the “Effective Date” above. Please check back occasionally to stay informed.

7. Governing Law

These Terms are governed by the laws of North Dakota, and any disputes will be handled in the courts located there.

  • Third-Party Fulfillment (Printify): As a reminder, all merchandise is produced and shipped directly by Printify’s production partners. While we handle customer service, any shipping or production delays will be managed through them.
  • Refunds and Returns: Film sales are final, but if you have issues accessing the film, reach out to us. Merchandise sales are also final, but we’ll help resolve any issues with faulty or damaged items received.

Clarification Regarding Printify:

  • Printify is a third-party print-on-demand solution that handles all aspects of merchandise production and shipping. By purchasing merchandise, you acknowledge that any issues regarding production or shipping are handled by Printify and its production partners, and we will work with them to address any problems.
